How section 4 is read

The courts give the predeceased child a notional share that passes to all of that child's heirs. The words of the section give it to their children alone. The two give different answers when that child left a widow or a surviving mother.

Common questions

Is this calculator a fatwa?

No. It is an educational tool that applies the classical rules of Faraid to the heirs you enter. Before dividing a real estate, confirm the result with a qualified Mufti, and with a lawyer for it to have legal effect where you live.

Why do I have to choose a school of law?

The four Sunni schools agree on the great majority of cases and differ on a few — most visibly when a grandfather competes with brothers. The calculator will not guess, because guessing would hand most people a confidently wrong answer.

Why does the total sometimes come to more than the estate?

When the fixed shares add up to more than the whole estate, every share is reduced in proportion and the denominator rises. This is called awl, and the result page says when it has happened.

Does a wife take one eighth each, or one eighth between them?

Between them. However many wives there are, they divide a single share — one quarter where there is no child, one eighth where there is.

What does the Pakistan law option change?

Section 4 of the Muslim Family Laws Ordinance 1961 gives the children of a son or daughter who died before the deceased the share their parent would have taken. Classical rules exclude them where a living son survives. It is statute, not fiqh, so it is off by default.

Do my Islamic shares apply automatically where I live?

In Pakistan, Islamic shares are the default legal position. In the UK, the US, Canada, Australia and much of Europe they are not — without a valid will, local intestacy law divides the estate instead. Calculating your shares is the first step; making them binding is a separate one.
